Eligible disputes

First try to reach an agreement with the neighbour. Fence viewers apply when a new line fence is proposed or an existing shared-line fence needs repair or reconstruction and the owners cannot agree.

They cannot resolve the property line itself and cannot assist once construction has already started. A survey or legal process may be a separate need; do not confuse the viewing with boundary surveying.

Apply and pay

Complete the Request for Fence Viewers form and provide the $338.72 fee plus HST. Email cityclerk@cityofkingston.ca or mail the form and certified cheque or money order to City Clerk, 216 Ontario Street, Kingston ON K7L 2Z3.

Email applicants can pay at City Hall’s Payment Centre or by card over the phone at 613-546-4291 extension 2268. Ask that the receipt be forwarded to the Clerk. A form alone does not complete the application until payment is confirmed.

Scheduling and evidence

The process uses three fence viewers, each receiving daily remuneration. The Clerk schedules the arbitration once the file and fee are received and gives property owners at least one week’s notice.

Viewings do not occur from November 1 through March 31. Prepare a clear description of the proposed work and disputed cost or construction choices, and keep construction paused while pursuing this process.
